Terms of Service

1. PROVIDER IDENTIFICATION

The website www.otakuvillage.es (hereinafter, the "Site") is operated by Alejandro Jesús Alcántara Navarro, residing at Calle Mitja Galta Nº 15 1A, Burriana (Castellón), NIF 53788564M, and phone +34 604 838 670 (hereinafter, the "Provider" or "Otaku Village").
By using the Site and placing orders, the customer (hereinafter, the "User") declares that they have read, understood, and accept these Conditions, as well as the Privacy Policy, and that they have the legal capacity to contract.

2. PUBLICATION AND VALIDITY

These General Conditions are permanently published on the Website and may be modified by the Provider at any time. The conditions in effect at the time the User places their order will apply.

The electronic contract is archived by the Provider and can be consulted by the User upon request.

3. OBJECT OF THE CONTRACT

This contract regulates the sale of products offered by the Provider through the Site.

The contract is finalized when the User expressly accepts the conditions by checking the corresponding box during the purchase process. The order confirmation sent by email constitutes proof of the contract.

4. PRODUCTS

The products offered include collectible cards, merchandise, and items related to otaku culture. They are not toys and are not intended for children under 14 years old. Buyers must be adults or have parental or guardian authorization.

Product condition:

The condition of collectible products (cards, packs, boxes, figures, etc.) may show slight variations in packaging, corners, or sealing due to transportation from the origin. This will not be considered a defect unless the damage affects the contents.

Product condition

1. Some products sold are second-hand: they have been previously used, may show signs of use, and will be described in detail on each product page (photos, defects, wear).
2. Other products are in like new condition: these are new items but may have been opened by the seller (for example, upon receipt from Japan) to optimize packaging and reduce shipping costs. These products will be described as “like new” when in this condition and may come without the original seal.
3. Finally, some products are new and sealed: they will come with their original factory seal, unless the product description states otherwise.

Indicative content:

Images of sealed products are indicative and do not guarantee specific content unless expressly stated otherwise.

Notice about brands:

Otaku Village is not affiliated with, sponsored by, or authorized by the brands whose products it sells. All brands, logos, and images belong to their respective owners. Some images may come from external sources and will be replaced by photographs of the actual product when appropriate.

5. PRICES AND COSTS

Prices include the current VAT in Spain.

Shipping costs are calculated according to the selected carrier (Inpost Punto Pack, Correos, or others) and are shown before completing the purchase.

Price or stock errors: In case of a clear error (for example, clearly incorrect price, technical failure, or nonexistent stock), Otaku Village may cancel the order, informing the User and fully refunding the amount.

6. PURCHASE PROCEDURE

1. Select the products and add them to the cart.
2. Complete your personal and shipping information.
3. Select the payment method.
4. Read and accept these Terms by checking the mandatory box.
5. Confirm your order.

The User will receive a confirmation email that constitutes the electronic contract between both parties.

Otaku Village will not be responsible for delays or issues caused by incorrect or incomplete data provided by the User (address, e-mail, phone).

Pre-sales / reservations: Pre-sale orders will be confirmed based on availability and estimated release date. The Provider may limit units per customer and cancel orders suspected of abuse (for example: an order by the same buyer of 5 or more units), fully refunding the amount.

7. PAYMENT AND BILLING

The available payment methods are indicated on the Site. Payments may be subject to security checks by the payment platform to prevent fraud.

Billing:
According to current legislation (art. 164.1.3º Law 37/1992 and arts. 2, 3 and 9 of RD 1619/2012), in sales to consumers there is no obligation to issue an invoice unless the customer expressly requests it. The invoice will only be issued when the User requests it. All sales are recorded and declared in accordance with current regulations.

8. SHIPPING

Shipments are made through carriers such as Inpost Punto Pack or Correos (or other agreed carriers). Delivery times and tracking numbers will be indicated in the order confirmation. These times are estimated and may vary due to causes beyond Otaku Village's control.

If a package is returned due to an incorrect address or repeated absence of the recipient, the User will bear the costs of a new shipment.

If the package shows visible external damage, the User must report it to the carrier at the time of delivery to activate the shipping insurance.
Otaku Village is not responsible for delays attributable to the carrier.

9. RETURNS AND RIGHT OF WITHDRAWAL

The User has 14 calendar days from receipt of the order to exercise their right of withdrawal. The product must be returned in perfect condition and with its original packaging. Return shipping costs will be borne by the Provider unless otherwise indicated.

Exceptions to withdrawal:

• Sealed products that have been opened.
• Personalized or made-to-order products (including pre-sales when indicated).
• Incomplete products, without original accessories or elements.

Returns due to withdrawal do not include the original shipping costs and must be paid by the user, unless the error is attributable to the Provider.

9. WARRANTY 

All products sold by Otaku Village to consumers in Spain are covered by the legal warranty of conformity according to Spanish and European regulations. In particular:

• For new items, Otaku Village guarantees that the products will be compliant for a period of three years from delivery.
• For second-hand items, the agreed warranty period will be one year.

10. PRE-SALES

Pre-sale products made or prepared exclusively according to customer specifications or limited editions are not subject to the right of withdrawal, according to art. 103.1.b LGCU. 

11. LIABILITY

Otaku Village is not responsible for:

• Improper use of products or manipulations that alter their value.
• Delays or losses caused by the carrier.
• Purchases made by minors without authorization.
• Variations in product availability subject to manufacturer or distributor quotas.

Pre-sale release dates depend on the supplier and may change without Otaku Village assuming responsibility.

12. APPLICABLE LAW AND JURISDICTION

These terms are governed by Spanish law. In case of conflict, the courts of the consumer's domicile will have jurisdiction, according to current regulations. If any clause is declared invalid, the rest of the text will remain applicable.

13. LOYALTY PROGRAM (AMBU OV)

Otaku Village has a loyalty program ("Ota-Club") that allows registered users to obtain exclusive benefits and advantages.

• How It Works: Users can earn points through various actions, such as making purchases (5 points for every €1), leaving reviews on purchased products, or following us on our Instagram profile.

• Point Redemption: Accumulated points can only be redeemed for direct discounts on future purchases through our online store (examples: discounts of €5, €10, €15, or €20 depending on the accumulated point balance).

• Management: To access the program, check point balances, or redeem rewards, the User must log into their personal account through the loyalty icon/button available on our website. Participation in the program implies acceptance of these terms.
